Terms of Business

YOUR CONTRACT WITH ANCHOR RECRUITMENT ("THE CONTRACT")

This website is operated by Anchor (On-line) Recruitment ("We","us" or "our"). The following terms of business, as updated from time to time and published on this website, shall apply between Anchor (On-Line) Recruitment and the prospective employer ("The Client") in respect of the engagement of any person introduced or presented by Anchor (On-line) Recruitment and/or any other services provided to the Client.

The terms of business governing any given services will be those in effect at the date of commencement of delivery of the services by Anchor (On-line) Recruitment. We will display the date when these terms of business were most recently updated on the website.

You will be deemed to accept these terms of business by virtue of an introduction to, or the engagement of an Applicant unless otherwise agreed in writing with the proprietor of Anchor (On-line) Recruitment. These terms of business shall prevail over any other terms of business or purchase conditions put forward by you. No variation or alteration of these terms of business shall be valid unless approved in writing by the Proprietor of Anchor (On-line) Recruitment.

SERVICES/PAYMENT

1. The "Full Recruitment Service"

Under the Full Recruitment Service Anchor (On-line) Recruitment offers to advertise a  vacancy on the website, to take inquiries from potential applicants ("Applicants"), to screen Applicants' CVs and to interview Applicants.

A "Placement Fee" is payable by the Client in respect of any person introduced personally or presented verbally or in writing to the Client by Anchor (On-line) Recruitment and who is within 9 months of such introduction engaged by the Client (either on a contract or permanent basis) whether or not the appointment is for the position for which the person was originally introduced (an "Engagement"). The Placement Fee is payable when the Applicant commences employment persuant to the Engagement.

The Placement Fee will be calculated on the basis of a percentage of the annual basic gross salary paid to the Applicant, as follows:

  • Up to £19,999 8%
  • £20,000 to £29,999 9%
  • £30,000 and above 10%

For Clients who regular recruit ( placing minimum of five vacancies) through our company we offer as yearly reduction on the figures quoted above.

3.  On-site assistance

For Clients who require the attendance of Anchor (On-line) Recruitment personnel on site at their own premises our consultancy fees are calculated at £350 per day. If more than 50 miles radius from our office a charge for travelling may be made.

PAYMENT TERMS

Payment for all Anchor (On-line) Recruitment services is required within 14 days of the date of our invoice. We reserve the right to charge 2% interest per month on any overdue sum that is outside the payment terms until the correct payment is received.

Payment can be made online on the secure website, or by cheques payable to Anchor (On-line) Recruitment and sent to [Suite 1, Willow House, Bournes Place, Woodchurch, Ashford, Kent TN26 3PD]. The advertising will commence once the correct payment has been received and cleared (where applicable) and you have been notified.

Payment may be made by debit card or credit card. We accept all major debit and credit cards.

You agree to indemnify us in full against all costs, expenses and outgoings incurred by us obtaining payments from you in the event a failed payment occurs. This will include an administration charge of not less than £20. We may at any time after a failed payment has occurred ask a debt collection agency to collect payment from you.

YOUR ACCOUNT

Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when registering.

Anchor (On-line) Recruitment reserves the right to refuse access to the website and may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these terms of business.

You can cancel this agreement at any time by informing us in writing or by email. If you do so, you must stop using the website. The suspension or cancellation of your registration and your right to use the website shall not affect either party's rights or liabilities.

YOUR CONDUCT

You must not use the website in any way that causes, or is likely to cause, the website or access to it to be interrupted, damaged or impaired in any way.

You understand that you, and not Anchor (On-line) Recruitment, are responsible for all electronic communications and content sent from your computer to us and you must use the website for lawful purposes only.

You must not use the website for any of the following:

  • for fraudulent purposes, or in connection with a criminal offense or other unlawful activity;
  • to send, use or reuse any material that is illegal, offensive, abusive, indecent, defamatory, obscene or menacing; or in breach of copyright, trademark, confidence, privacy or any other right; or is otherwise injurious to third parties; or objectionable; or which consists of or contains software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any 'spam'; or
  • to cause annoyance, inconvenience or needless anxiety.
PRIVACY

The privacy of our users is important to us and we take care to safeguard it. This policy explains how we use your personal information.

When you register as a user, we will collect the information necessary to provide the service which includes, as a minimum, your name, address, contact telephone numbers and an email address.

We will also collect information from you if you complete any other forms on our site or if you contact is with comments or specific requests.

All personal information is stored in secure databases. Access to that information is strictly controlled and limited to certain individuals within our company. If your email address or any of your other contact details change, please let us know so that we can update our records.

We will not share your data with any third parties other than where necessary for the provision of the relevant services to you.

You can continue to use the website without registering. This gives you anonymity but you will not be able to take full advantage of our service.

We automatically collect information about your visit to our site. This information is used to make your visit to our site more efficient, and to help us follow browsing preferences on our site so that we can make regular improvements.

ANCHOR (ON-LINE) RECRUITMENT'S LIABILITY

This website is provided by Anchor (On-line) Recruitment without any warranties or guarantees. You must bear the risks associated with the use of the internet.

Anchor (On-line) Recruitment endeavors to ensure suitability of any Applicant introduced to the Client. Notwithstanding this is the Client shall satisfy itself as to the suitability of the Applicant and shall take up any references provided by the Applicant and/or the Applicant's past and current employers before engaging such Applicant. The final decision to engage a candidate is the Client's alone. the Client shall be responsible for obtaining work and other permits if required, for the arrangements of medical examinations and/or investigations into the medical history of any Applicant, and satisfy any medical and other requirement or qualification required by the law of the country in which the Applicant is engaged to work.

Anchor (On-line) Recruitment makes no warranties, representations or undertakings about:

  • any of the content of this website (including, without limitation, as to the quality, accuracy, completeness, non infringement of third party rights or fitness for any particular purpose of such content); or
  • any content of any other website refereed to or accessed by hypertext link through this website ("3rd party site").
Anchor (On-line) Recruitment does not endorse or approve the content of any 3rd party site, nor will Anchor (On-line) Recruitment have any liability in connection with any of them (including, but not limited to, for any loss or damages whatsoever howsoever arising as a result of accessing any 3rd party sites or liability arising out of any allegation that the content of any 3rd party site infringes any law or the rights of any person or entity).

To the full extent allowed by applicable law, you agree that we will not be liable to you/or any third party for any consequential or incidental loss or damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arises out of or are related to the provision of Anchor (On-line) Recruitment's services and/or this website.

Nothing in these Terms and Conditions shall exclude Anchor (On-line) Recruitment's liability for personal injury of death caused by its negligence.

Although Anchor (On-line) Recruitment aims to offer you the best service possible, Anchor (On-line) Recruitment makes no promises that the services will meet your requirements . Anchor (On-line) Recruitment cannot guarantee that the service will be fault free. If a fault occurs in the service you should report it to us on 01233 861470 immediately.

Your access to the website may occasionally be restricted to allow for repairs, maintenance or the introduction of new facilities or services. Anchor (On-line) Recruitment will attempt to restore the service as soon as it reasonably can.

INTELLECTUAL PROPERTY

The contents of these pages are copyright Anchor (On-line) Recruitment 2005. You may download to a local hard disk and print extracts from this website for personal use. You may also recopy downloaded extracts to others provided you do not do so for profit.

However, reproduction of part or all of the contents in any form is prohibited unless for personal use. Anchor (On-line) Recruitment makes no promise that materials on the website are appropriate or available for use in locations outside the United Kingdom, and accessing the website from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.

MISCELLANEOUS

You may not assign, sub-license or otherwise transfer any of your rights under these terms of business.

If any provision of these terms of business is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms of business, which shall remain in full force and effect.

If you breach these terms of business and Anchor (On-line) Recruitment ignores this, Anchor (On-line) Recruitment will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the terms of business.

Anchor (On-line) Recruitment shall not be responsible for any breach of these terms of business caused by circumstances beyond its control.

A person who is not a party to these terms of business shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these terms of business but this shall not affect any right or remedy of a third party which exists or is available apart from the Act.

The Anchor (On-line) Recruitment website is owned and operated by Anchor (On-line) Recruitment whose registered office is Willow House, Bournes Place, Woodchurch, Ashford, Kent, TN26 3PD.


The Client shall notify Anchor (On-line) Recruitment of any offer to engage an Applicant for a job for which the Applicant was originally introduced or for any other job offered by the Client (either on a contract or permanent basis).

Introductions or presentations to the Client of any Applicants are strictly confidential.

The disclosure to a third party of any details regarding thew Applicant introduced by Anchor (On-line) Recruitment which results in an Engagement with that third party within 6 months of the introduction renders the client liable to pay the Anchor (On-line) Recruitment Placement Fee as set out in these terms of business.

2. The Advertising Service

Clients may use our service purely to advertise a vacancy only, with all enquires referred back to the Client (the "Advertising Service"). The fee for the Advertising Service is £200 for 6 weeks of advertising in the website (the "Advertising Fee").

Payment of the Advertising Fee is required at the time of placing the advert which will run for a 6 week period on our website with a job reference number as identification.

For Clients who want their vacancy advertised on our website and decide to use of the Full Recruitment Service, the conditions above relating to the Full Recruitment Service apply and a refund of 25% of the Advertising Fee of £200 will be deducted from the Placement Fee if a successful placement provided by Anchor (On-line) Recruitment and payment was made at the of using the Advertising Service.
